b. Limited License: You are granted a limited, non-exclusive, and non-transferable license to access and use our website and services for personal, non-commercial purposes. All Galavant & Gather digital pattern may be used to produce handmade items for sale, but may not be used for mass production without additional licencing.

a. Prohibited Activities: Users are prohibited from engaging in activities that violate these Terms of Service or any applicable laws. Prohibited activities include, but are not limited to, unauthorized access, data scraping, and interference with our services.

Booking Terms and Conditions for Travel and Tours

 

These Booking Terms and Conditions ("Terms") govern the relationship between Galavant and Gather ("the Company") and the person or entity booking travel and tour services ("the Client"). By making a booking with the Company, the Client agrees to be bound by these Terms.

1. Booking and Confirmation:
   1.1 To secure a booking, the Client must pay the required deposit as specified by the Company.
   1.2 The booking is considered confirmed once the deposit is received and the Company issues a confirmation invoice.

2. Payment:
   2.1 Full payment for the booked services is due [X] days before the commencement of the tour.
   2.2 Failure to make full payment by the specified date may result in the cancellation of the booking.

3. Cancellation and Refunds:
   3.1 Cancellation by the Client:
       - 3.1.1 Cancellations made 120 days prior to the tour commencement date are eligible for a refund of the purchase price minus a 10% cancellation fee.
       - 3.1.2 Cancellations made between 119 and 31 days prior to the tour are subject to a 50% cancellation fee.
       - 3.1.3 Cancellations made within 30 days of the tour are non-refundable.
   3.2 Cancellation by the Company:
       - 3.2.1 The Company reserves the right to cancel a tour due to unforeseen circumstances. In such cases, a full refund will be provided.

4. Changes to Itinerary:
   4.1 The Company reserves the right to make changes to the itinerary, accommodations, or transportation due to unforeseen circumstances or force majeure.
   4.2 The Company will make reasonable efforts to inform the Client of any significant changes as soon as possible.

5. Travel Insurance:
   5.1 The Client is strongly advised to obtain travel insurance covering cancellations, medical expenses, and other potential risks.

6. Liability:
   6.1 The Company is not liable for any loss, injury, damage, delay, or inconvenience caused to the Client unless due to the Company's negligence.
   6.2 The Client acknowledges that travel involves inherent risks, and the Company is not responsible for any personal injury or property damage.

7. Australian Consumer Law:
   7.1 These Terms do not exclude, restrict, or modify the application of any provision of the Australian Consumer Law (ACL) as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
   7.2 If the Client is a consumer under the ACL, certain guarantees may be conferred on the Client, which cannot be excluded, restricted, or modified.

8. Governing Law:
   8.1 These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of that state.

By making a booking, the Client acknowledges that they have read, understood, and agree to abide by these Terms and Conditions.
